An Employee Quitclaim is a document where an employee waives his / her employment claims against the employer. The employee executes this when the employer and employee agree to settle a dispute, or in order to avoid potential disputes (which can be costly and lengthy).
An employee executes the Employee Quitclaim once the employment relationship ends in order to settle all possible claims the employee may have against the employer. The employee may also execute this to end an ongoing dispute with the employer.
As a general rule, the Employee Quitclaim must (a) be voluntarily entered into by the employee; and (b) consists of a reasonable settlement. The employer must not have used any fraud or coercion on the employee. Further, the settlement amount must be reasonable.
Otherwise, if either one of the above requisites is absent, the Employy Quitclaim won’t be valid and the employee may still file his claims against the employer arising from the employment relationship.
An Employee Quitclaim protects the employer from all of the employee’s claims arising from the employment relationship. Once the employee executes the Employee Quitclaim, the employee can no longer file a claim against the employer. In exchange, the employee receives money from the employer.
The Employee Quitclaim is intended to (a) bring peace between the employer and employee; (b) settle all issues between them; and (c) prevent costly and lengthy litigation.
